By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services. These Terms constitute a legally binding agreement between you and PlayNexy GmbH.
At a a Glance: Your use of PlayNexy's gaming applications is conditioned on compliance with our platform rules. We collect minimal data to provide and improve our services, as outlined in our Privacy Policy. You retain ownership of your game data and user-generated content. We enforce a clear, fair process for account issues and dispute resolution.
1. Scope of These Terms
These Terms apply to all users of the PlayNexy ecosystem, including players, developers, and guests. The term "Services" encompasses our desktop and mobile applications, our website (playnexy.online), backend infrastructure, APIs, and any related customer support.
"Content" refers to all text, graphics, software, audio, video, data, and other materials you create, upload, or share through our Services. "User Content" means Content you specifically post or submit. "PlayNexy Content" refers to all materials we provide, including code, graphics, and design elements.
Legal Entity Note
These Terms are with PlayNexy GmbH, a company registered in Germany. If you are using our Services on behalf of an organization, you represent and warrant that you have the authority to bind that entity to these Terms.

- • User-Generated Content (UGC): Any content you create within our games.

- • Subscription: Any recurring payment plan for premium features.
2. Your Rights and Responsibilities
Account Creation & Security
To access full features, you must create an account with accurate information. You are responsible for safeguarding your password and for all activities that occur under your account. Notify us immediately of any unauthorized use of your account. We recommend enabling two-factor authentication where available.
Note: Creating multiple accounts to circumvent restrictions or bans is a violation of these Terms.
Acceptable Use of Services
You agree to use PlayNexy Services only for lawful purposes. Prohibited activities include: violating any local, state, national, or international law; infringing upon intellectual property rights; distributing malware; engaging in harassment, hate speech, or discriminatory behavior; or attempting to interfere with the proper functioning of the Services.
User-Generated Content (UGC)
You retain ownership of your User-Generated Content. By submitting UGC, you grant PlayNexy a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, and display such UGC in connection with providing and promoting our Services. You represent that you own or have the necessary rights to the content you share.
Trade-off: While you retain ownership, granting this license is necessary for us to feature your creations within our ecosystem (e.g., sharing screenshots, leaderboards, community feeds).
3. Intellectual Property Rights
PlayNexy's IP
All PlayNexy Content—including software, visual design, logos, text, and game mechanics—is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our software for personal, non-commercial purposes. You may not copy, modify, reverse-engineer, or distribute our proprietary code.
Our IP is the foundation of our gaming platform.
Reporting Violations
We respect the intellectual property rights of others. If you believe that your work has been copied in a way that constitutes copyright infringement, please provide our designated agent with the following information: a description of the copyrighted work, the location of the infringing material, your contact information, and a statement of good faith belief. 4. Termination & Limitation of Liability
Termination
You may terminate your account at any time. Upon termination, your right to use the Services will immediately cease.
"AS IS" Disclaimer
The Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that the Services will be uninterrupted, secure, or error-free. You use them at your own risk.
Limitation of Liability
To the fullest extent permitted by law, PlayNexy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability to you for any claim shall not exceed the amount you paid us in the six months prior to the claim.
Indemnification
You agree to indemnify, defend, and hold harmless PlayNexy, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Services.
5. Governing Law & Dispute Resolution
These Terms are governed by the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Berlin, Germany.
